Commercial Electronic Messages

As a proudly Canadian business serving Canadian physicians, we follow Canada's Anti-Spam Legislation (CASL) strict regulation of Commercial Electronic Messages. 

We will only communicate commercial electronic messages with your consent (either express or implied).

What are commercial electronic messages?

According to Government of Canada's website, the definition of spam is unsolicited email, text messages and software. 

It can also include: 

  • unauthorized alteration of transmission data
  • the installation of computer programs without consent
  • false or misleading electronic representations (including websites)
  • the harvesting of addresses (collecting and/or using email or other electronic addresses without permission)
  • the collection of personal information by accessing a computer system or electronic device illegally

CASL focuses on commercial electronic messages, which are those that encourage participation in a commercial activity whether or not there is an expectation of profit.

What is CASL's definition of consent?

CASL has two definitions of consent: 

  • Implied Consent
    Under subsection 10(9) of CASL, the government dictates that consent is not explicitly stated but can be legally inferred under specific conditions. 
    • Existing Business Relationship: This is established if the recipient has done any of the following within the time frames specified in subsection 10(10) of CASL:

      • Entered into a written contract or accepted a business/investment opportunity that is currently active or expired within the previous 2 years.

      • Made an inquiry or application about your products or services within the previous 6 months.

  • Express Consent:
    Express consent means someone has agreed (verbally or in writing) to receive a commercial electronic message. To meet this standard, the request for express consent must be a positive, explicit action taken by the recipient.
    • The Opt-In Rule: The user must explicitly choose to give it. There is no time limit unless the you withdraw your consent. Clients can give their consent either in our Letter of Engagement or by signing-up for our newsletters or by downloading our personal finance resources (calculators, apps, or white papers).
